基于专利池的高科技产业技术标准开发联盟内外部治理机制研究

In order to solve the problem that technology innovation and technology standard are separated from each other in Chinese hi-tech industry, China must set up technology standard development alliance with his own intellectual property rights by patent pool. This project will study technology standard development alliance governance through theories of cross-network externality, option game and innovation ecology. Firstly, this project will study technology standard and its formation, and then explore alliance inside governance from the relations of alliance members, including governance structure, standard developing timing, member entry and income distribution. Secondly, this project will study the licence mechanism of technology standard and alliance outside governance from the relations between alliance and standard licensee, including the entry mechanism of complementary technology developer and product manufacturer, cost subsidy and licence pricing between alliance and standard licensee. Finally, this project will provide analytical framework, methods and principles of control right and organization rent allocation among patent holder, standard alliance, complementary technology developer and product manufacturer, and also provide theory basis and methods of industry policy for government. This project will try to put forward universal scientific problems from Chinese management practices and propel the formation and perfection of techology standard theory.

针对中国高科技产业技术创新体系与技术标准化体系脱节的弊端，以"专利池"为核心，以组建具有自主知识产权的技术标准开发联盟为抓手，将交叉网络外部性理论、期权博弈模型、创新生态学方法引入到联盟治理研究领域，通过研究高科技产业技术标准及其开发联盟形成机理，从联盟成员之间关系视角，深入探讨联盟治理结构、技术标准开发时机、联盟成员准入及收益分配机制等联盟内部治理基础性问题。通过研究技术标准许可机理，从联盟与技术标准被许可方之间关系视角，深入探讨配套技术开发商与产品制造商准入机制、联盟与被许可方之间成本补贴及技术标准许可费定价等联盟外部治理基础性问题。为专利持有者、技术标准开发联盟、配套技术开发商、产品制造商之间控制权与组织租金合理配置提供一般性分析框架、方法及规则，为政府制定产业政策提供理论依据与方法支撑。尽可能从中国最新管理实践中凝练具有一定普适意义的崭新科学问题，推动技术标准理论体系的形成与完善。

针对中国高科技产业技术创新体系与技术标准化体系脱节的弊端，以“专利池”为核心，围绕构建具有自主知识产权的技术标准联盟为主线，本项目研究了高科技产业技术标准联盟形成机理，包括技术标准化机理、竞争优势培育、技术标准化下创新生态系统技术之间的依赖关系、跨产业转型企业知识转移模式，作为技术标准联盟的运作形态——专利池，本项目研究了专利池的形成机制、内部各技术之间的关系。在此基础上研究了高科技产业技术标准联盟内部治理问题，围绕技术标准联盟内部各成员之间的治理关系展开研究，重点研究了技术标准化下集成创新企业与零部件开发商合作创新类型与治理结构匹配，技术标准联盟（专利池）内部成员的网络位置关系，引入技术多元化因素，探讨了联盟成员在技术标准制定中的实力地位对比。最后，研究了高科技产业技术标准联盟外部治理，包括高科企业以技术标准为纽带形成的创新生态系统及其平台领导、平台竞争问题，围绕技术标准对外许可这一关键外部治理变量，研究了高科技企业技术标准的对外多边许可数理模型、许可定价、许可策略等问题。本项目重点选择移动通讯、汽车、数字家电等产业技术标准联盟作为调研对象，实证研究了技术标准联盟及相关专利池形成、技术结构关系、分类治理方法、对外许可定价等问题。项目在研期间，已发表论文16篇，其中，SCI英文源刊论文2篇、CSSCI源刊论文14篇。后续已录用排队发表论文4篇，其中，SSCI英文源刊论文1篇、CSSCI源刊论文3篇。指导全日制硕士生10人。项目在研期间，参加6次国内外举办的国际学术会议，达到了项目预期研究目标。项目研究形成的一整套关于专利池、技术标准联盟的形成机制、运作模式、定价机制等理论和方法，对企业创新能力及标准化能力构建、产业标准构建与定价提供重要重要指导作用。
